CONSTITUTION
AND BYLAWS

NAME OF ASSOCIATION:
The name of this association shall be "Lone Star - Mohawk Property
Owners Association."
PURPOSE OF ASSOCIATION:
The purpose of
this association is to represent the owners of those certain properties
located on the "Lone Star." "Mohawk 3" and "Mohawk
4" claims as accessed by Forest Road. North of the Walker Township,
in Prescott National Forest, Yavapai County, Arizona.
MEMBERSHIP:
The members of the association
shall be limited to those persons who actually own property in the above
designated area, or their representatives.
METHOD OF ACQUISITION
OF RIGHT OF WAY:
Right of way for the above access road shall be acquired by agreement with
the U.S. Forest Service and shall be in the form of a FLPMA Private Road
Easement, details of which will be worked out with the Forest Supervisor
his representatives and which shall be maintained under separate cover by
the association and by easement from the owners of private property.
IMPROVEMENT AND MAINTENANCE:
Acquired right of way shall be improved and maintained in accordance with
the special use permit by the members of the association as required at
any specific time.
A copy of an agreement
regarding appropriation of maintenance work and expense among the members
will be supplied to the Forest Supervisor or his representative upon request.
Supplies such as surfacing
material for the road are to be acquired by agreement with the US Forest
Service from sources and in a manner to be agreed upon by the Forest Supervisor
his representatives.
RECORDS:
The association shall maintain records showing expenditures of funds or
effort by the association, agreements arrived at during meetings and such
other records to reflect in an orderly manner, the business conducted by
the association. These records shall be made available to the Forest Supervisor
his representatives upon request.
OFFICERS:
A President, Secretary and Treasurer shall preside at meetings and shall
be elected by vote of a majority of members and shall serve until removed
by either resignation or majority request.
DUTIES OF OFFICERS:
The President shall preside
at meetings and shall be responsible for overseeing the operation of the
association and assuring its compliance with agreements made by it.
The Secretary shall
be responsible for the keeping of records, the minutes of meetings and such
other duties as are appropriate to the job of Secretary.
The Treasurer shall
be responsible for the handling of the monetary accounts and such other
duties as are appropriate to the job as Treasurer.
Officers of this association
are to serve without pay, unless decided otherwise by a majority vote of
the membership.
The listings of current
membership shall be kept under separate cover and a copy provided to the
Forest Supervisor or his representative upon request.
